Recently, we settled another dog bite case. This one involved a meter reader for a utility who was in a back yard doing his work. My client tells me that this is the second time this had occurred. While he did obtain workman's compensation benefits, that only provides payment of medical bills and 2/3 of his lost wages, but nothing for pain, suffering and a lifetime scar. Under these circumstances, we proceeded against the owner of the dog and his homeowner’s insurance carrier. So the client can make a recovery under workers compensation and against the home owner. Luckily this client had a mild injury, but some bites can cause a very serious injury. As I have said, the law in most localities requires that a dog be leashed when outside. In this case, the dog was out and on the loose.
