Forfeiture of Money Cases

Forfeiture cases. Lately we have been getting a number of forfeiture cases. These matters involve the seizure of money found on persons or in their automobiles when that person is arrested for a drug offense by local police officers. The amounts involved in our cases range from $1,000 to $25,000. The police officers just take the money, and later the person gets a notice from the local office of the Commonwealth's Attorney that the money is to be forfeited to the Commonwealth of Virginia because the money is the product of the sale of illegal drugs or it is used in the sale of illegal drugs. The Virginia law involved is Section 19.2-386.22 of the Code of Virginia. In many cases the person just accepts the loss of the money and does not appear in Court to fight the forfeiture.
We have had quite a bit of success in these matters and handle the cases on a contingency basis, so our clients do get a substantial portion of their money back by taking these matters to court.
