The laws in Virginia regarding punitive damages involving drunken driving claims require that the following must be proven when there is a personal injury:
- The driver causing the accident had a blood alcohol concentration of 0.15 or higher;
- When the driver began drinking alcohol, he or she should have known that the ability to operate a motor vehicle would be impaired, or while operating the motor vehicle, the driver knew or should have known that he or she was impaired;
- The driver's intoxication was the proximate cause of the injury to the plaintiff.
