Can I and my spouse use the same attorney for our divorce for the purpose of saving money?

 

A: It is not ethical for an attorney to represent both opposing clients in a single case, especially a husband and a wife in a divorce action. Many cases are often handled by only one attorney handling all the paperwork and the unrepresented party may act as their own attorney and deal with the represented party’s counsel. In that case the attorney cannot give out any confidential information or the legal advice to the unrepresented spouse.
