Can I be arrested and charged with a DUI/DWI if my blood alcohol content (BAC) was below .08?

 

A: Yes. If you were unable to operate your motor vehicle safely due to the influence of drugs or alcohol, you could be arrested for a DUI/DWI even if your BAC was lower than the presumptive legal limit.
