Does the failure of the police to give the Miranda warnings prior to arrest operate to make your arrest unlawful?

 

A: No. The failure to give the Miranda warnings may operate to disqualify evidence obtained or seized which may not have been otherwise available to use against the accused had the warnings been given. Even if you are lawfully arrested and given the Miranda warnings you should never consent to or give a statement nor should you consent to a search of your person, home, vehicle, or otherwise without first consulting with counsel.
