How are assets distributed in Virginia divorce proceedings?

 

A: Virginia uses an “equitable distribution” theory for dividing martial assets among the spouses. Equitable distribution does not necessarily mean that marital assets will be split 50/50 between the spouses. Under this theory, the court seeks to distribute assets in a manner that is fair and just in light of the circumstances.
