Q: How does mediation differ from arbitration?

A: During the cooperative process of mediation a neutral third party (mediator) is employed to facilitate the resolution by facilitating consensus building and discussion, and ensure that a mutually satisfactory resolution is reached. During the arbitration process a neutral party called an arbitrator plays a third party role that will listen to both sides and make a decision that will usually be binding.
