Q: Will a traffic court's determination of guilt or innocence affect the outcome of my civil suit for personal injury?
A: No. The determinations of a traffic court are based upon the higher burden of proof, guilt beyond a reasonable doubt. Civil suits are generally subject to the lower burden of proving your case by the greater weight of the evidence. Statements that you make in traffic court may, however, be used against you in a civil suit. If you are required to go to traffic court in a case involving the possibility of a personal injury claim you should contact our office to arrange a free initial consultation.
