During its 2007 Session, the Virginia General Assembly passed house Bill 3202, which instituted new civil remedial fees for driving offenses. The new fee schedule went into effect on July 1, 2007 and applies only to those crimes committed after that date.
These fees are assessed against any Virginia resident who is convicted of certain motor vehicle-related or driving crimes. They will not apply to simple traffic infractions like failure to yield or parking too close to a fire hydrant.
These civil remedial fees are not new fines for the offenses, but rather are additional fines. In some ways, they operate like court costs. The court has no discretion to reduce or suspend any of the new fees. Each fee is paid in three stages: first upon conviction, the second within fourteen (14) months of conviction, and the third must be paid within twenty-six (26) months of the conviction. The Virginia Department of Motor Vehicles will remind you when your second and third payments are due.
FEE SCHEDULE
- Driving on a Suspended License: $750 total, in three equal payments of $250
- Reckless Driving: $1050 total, in three equal payments of $350
- Driving Under the Influence (DUI): $2,250 total, in three equal payments of $750
- Other Misdemeanors: $900 total, in three equal payments of $300
- Other Felonies: $3,000 total, in three equal payments of $1,000
PREPAYABLE OFFENSES: For the following offenses, you have the option of pleading guilty and not attending court. If you choose to do this, you may simply prepay the fine and the first part of the civil remedial sanction. Each prepayable offense requires a $61 processing fee which must be paid with the first payment.
- Drinking Alcohol While Driving: $35 fine, plus $900 fee in three equal payments of $300.
- Refusing Officer’s Order to Drive to Weighing Station: $35 fine, plus $900 fee in three equal payments of $300
