Losing your job after a DUI conviction

There are many consequences of being convicted of driving while intoxicated. You can be fined, forced to spend time in jail, you may lose your license, you may be required to attend driving school or use an ignition interlock device. These consequences are challenging and can make your daily life very difficult.

But that isn’t the end of it. One thing many people don’t realize is that you can lose your job after a DUI conviction. Your employer may have policies in place that will lead to your termination if they find out you were convicted of driving while intoxicated, or if you miss time from work because you spend time in jail or because you have community service to fulfill, or because you’ve lost your license and have trouble getting to work.

Even if you are not fired, your employer may limit your job activities to those that do not involve driving, or they may limit your work in other ways. These changes can affect your ability to make a living or may affect your enjoyment of your work.

For individuals with security clearances, being convicted of a DUI can be especially detrimental. If you work for a government agency, subcontractor or are working on a government project, your background may be subject to an extra level of scrutiny. If you are found to have a DUI, you could lose your job or your clearance or you may be unable to get a security clearance in the future.

To add insult to injury, if you lose your job you may have trouble finding another. Many employers will not hire people with a DUI conviction in their driver’s history. Some employers will check your driver’s record as far back as your home state goes, and others have a set period of time that they check (for example, they’ll go back 3 or 5 years).
