What to expect after a Virginia DUI arrest

If you’ve been arrested for driving under the influence of alcohol in Virginia, you may be asking yourself “what’s next?”

• Your rights: After your arrest the police officer should read you your rights. Avoid the temptation to make excuses for your situation or say negative things about the officer. Anything you say now can be used against you later – and you can be sure it will be.
• Off to the police station: after being caught driving drunk, you may be handcuffed and taken to jail. You’ll stay here until you either go to arraignment or you post bail.
• What about your car? If there is another licensed driver in the car who has not been drinking (the police will make sure of this) then they have the option to drive your car away from where you were arrested. If you were the only person in the car of if the other occupants of the car are either unlicensed or too intoxicated to drive, your car will be towed. Guess what – that impound fee is one more thing you’ll have to pay for.
• License suspension: In Virginia, your license can be suspended automatically for a set period of time if your blood alcohol content is over a certain level or if you are under 21 – or if you refused the breathalyzer test. It is possible to challenge the suspension of your license, but this has to be done quickly and effectively.
