Record $677 Million Nursing Home Abuse Verdict

Posted on Aug 29, 2010

A verdict that is believed to be the largest nursing home abuse verdict in the country this year was handed down in a California court this month.  The $677 million verdict was decided by a jury in a class-action case against one of the U.S.’s largest provider of nursing home services.

The verdict was against Skilled Healthcare Group Inc., is a publically traded company.  Many of the approximately 16,000 nursing homes across the U.S. are run by for-profit public companies.  Critics contend that many publically held nursing home companies are more interested in making a profit for shareholders than they are in providing quality care for their patients.

The lawsuit alleged that Skilled Healthcare failed to keep 3.2 nursing hours per patient per day at 22 homes across the state of California.  Nursing home staff shortages are a challenge for the industry, and a concern for families of nursing home residents, who are at a greater risk for abuse when homes are understaffed.

The fact that Skilled Healthcare was unable to maintain even 3.2 nursing hours per patient is concerning, especially since the federal recommendation for nursing hours is 4.1 per patient.

Family members of residents in Skilled Healthcare facilities contended that their loved ones suffered from neglect and what could be considered abuse when staff was short and there were not enough people to take proper care of all the residents.
