Virginia Beach woman pleads guilty in deadly drunk driving wreck

The woman who was accused of killing one pedestrian and injuring another at Virginia Beach’s Town Center in a drunk driving crash has pleaded guilty to the charges against her.

 

The accident happened November 27, 2009 when Natasha Herzog, 29, was driving her Ford Explore4r on Columbus Street.  Herzog crashed into two pedestrians who were in a crosswalk, Hunter Richardson, 23, and Charlotte Staats, 23.

 

Richardson later died at the hospital from wounds he sustained in the accident, and Staats sustained serious leg injuries.

 

Herzog admitted to having been at a friend’s party before the accident.  According to a spokesperson for the Commonwealth’s Attorney she refused to take a breath test after the crash.  She was later found to have a BAC over the legal limit.

 

Herzog will be sentenced in January.  This was her second drunk driving conviction in five years.  In all, she pled guilty to involuntary manslaughter while driving under the influence, drunk driving that led to serious injury, a second drunk driving conviction in five years, and refusal to take a breath test.

 

In Virginia, under the implied consent law drivers are required to submit to testing to determine if they are intoxicated.  Failure to submit to a breath test can lead to a charge, as Herzog found in this case.
